1. The Agreement

This document sets out the terms and conditions of use of the betting services and constitutes an agreement ("the Agreement") between you ("the customer", "the member", "the user") and BetClick Limited ("BetClick", "the company", "we"), of 168A Camden Street, London, NW1 9PT, UK, a company registered in England and Wales under company number 5517750. www.betclick.com and www.betclic.com are fully owned and operated by BetClick Limited. By registering to the betting services and becoming a member, you consent at all times to be bound by this Agreement. We recommand you to print out the rules of the game and keep them at an easily accessible place. The company reserves the right to modify, suspend or withdraw use of the betting services, temporarily or indefinitely, at any time, without notification or compensation, subject to fulfilment of any outstanding commitments under this Agreement.

2. Amendments

You agree that BetClick may amend these terms and conditions at any time. Any such changes will be binding and immediately effective on posting on the website or notification. It is your responsibility to ensure that you are aware of the current terms and conditions, and you agree that use of the services constitutes acceptance of the changes.

3. Governing law

This Agreement is governed by the laws of England and Wales, whose courts shall have exclusive jurisdiction to settle any dispute. You acknowledge that access and use of betting services may be subject to legal restrictions and even forbidden in some countries. Thus, BetClick Limited does not accept the customers resident in the United States. It is the customer's responsibility to ensure the legality of their actions. BetClick cannot accept responsibility under the law in any other jurisdiction.

4. Registration

In order to access the betting services, you must register as a member and open an account by completing the online application form. You must be over 18 years of age to register and place a bet. The company reserves the right to ask for proof of age from any customer and accounts may be suspended until satisfactory proof of age is provided.

5. Personal information

The personal information required for registration is: first name, surname, gender, date of birth, place of residence, email address, phone number (optional), language and currency. You will also be required to provide login details of your choice, namely username and password. You shall ensure that all the details provided are accurate and kept up to date. You can access and edit your personal information at any time in the 'my account' section of this website or by contacting Customer Support. The company will use the strictest measures to protect the security of your personal information from any unauthorised access. You are solely responsible for the security of your username and password, which should not be disclosed to any third party. The company assumes that any transaction undertaken after the correct username and password are entered is made by the rightful account holder, and therefore valid. In no event will the company be liable for any loss suffered by you as a result of any unauthorised use or misuse of your personal details. To protect both the customers and itself against identity fraud, the company reserves the right to request, at any time, satisfactory proof of identity with a photo (copies of a valid passport / identity card and/or any payment cards used) and proof of address (recent utility bill or bank statement). Failure to supply such documentation may result in suspension of the account. Personal information is strictly confidential and will only be used to set up and manage your account, to build up customer profiles and to make available to you promotional offers from the company or its partners. It will only be passed on to third parties if this communication is reasonably required in order to comply with current legislation and regulations. Additional information used to provide a quick and effective service on the website is typically collected through the use of cookies.

6. Intellectual property rights

All designs, text and graphics, and their layout and arrangement and all other intellectual property rights relating to the betting services are our (or our licensor's) property. Any use of such items or rights without our express prior written consent is not permitted.

7. Limitation of liability

Without limiting the scope of the other provisions under this Agreement, you agree that the company will not be liable for any loss or liability resulting from, but not limited to: delays or interruptions to the service, errors in any information or services provided (such as entry and transmission of data), accidental transmission of viruses or other harmful agents, circumstances of acts of God, unauthorised use or misuse of your betting account. You agree that the company's total aggregate liability, if it is incurred, whatever the cause or form of the action, cannot exceed the sum of five hundred (500) Euros.

8. Indemnity

The customer accepts to defend and indemnify the company (including for reasonable legal expenses) along with its affiliated companies, company representatives, directors, agents and employees against any claim or complaint made by a third party, caused or resulting from a breach on his part of these conditions or any document included in it as a reference, or from a breach on his part of any laws or rights of these third parties.

9. Suspension and closure

In the event that a member has breached any of the terms and conditions of this Agreement, BetClick reserves the right, at any time, without prior warning, notification or compensation, and without prejudice to common law actions which may be taken, to suspend or close the member's account, to deny access to all or part of the betting services, to refuse to accept any bets or transaction or to withdraw promotional offers.

10. Account management

In order to place a bet you must have sufficient funds in your account. The account balance and history can be easily viewed and funds can be deposited or withdrawn at any time. The winnings will be automatically paid into the account as soon as the event is settled and can immediately be used to place further bets. Deposits into the account can be made at any time, either online through debit / credit card or offline via bank transfer or by cheque. The minimum deposit value is 15 Pounds or equivalent. Please note that the company applies a standard 2% handling fee for each transaction made via credit card. This fee will automatically be billed to the respective user's credit card. Withdrawals from your account can be requested at any time provided all payments made have been received. BetClick reserves the right to pay any requested withdrawal partly or in total via the same method of payment with which deposits were made. When using credit/debit card to make a deposit, the company may not accept any withdrawal request made within 14 days after the deposit. Any withdrawal transaction from the customer's betting account for an amount greater than or equal to 200 Euros is free of charge. For any withdrawal of money of less than 200 Euros, a sum of 5 Euros will be deducted for administrative costs. This sum will be deducted automatically from the amount transferred from the betting account to the customer's bank account. Any withdrawal involving deposits that have not been staked shall be subject to administrative charges of 3% of the amount requested in addition to the fixed charge of 5 Euros. Additional bank charges associated with payments made will be charged to the customer. Transactions can be made in the following currencies: Euros (EUR) and British Pounds (GBP). The company reserves the right to suspend the placing or payout of bets or gaming stakes respectively in certain currencies and to pay the balance in their favour in the corresponding currencies to the customer. For transparency, each customer is entitled to open one account only, therefore BetClick reserves the right to close any multiple accounts opened in the same name or anyway referable to the same person. Should the company have reasonable grounds to believe that fraud has been committed or attempted, the company reserves the right to cancel any related transaction, without prejudice to any other action.

11. Termination

Either party is entitled to close the account at any time. In the event of termination by the company, it shall give notice of the termination to you via electronic mail and as soon as reasonably practicable, refund the outstanding balance to you. In the event of termination by you, you shall first withdraw the entire balance from your account and then give notice of the termination to BetClick via electronic mail, fax or letter. In either case, termination will not affect any outstanding bets, which will be normally settled when the results are known.

12. Promotions

Customers may be eligible to participate in bonus programmes, whose conditions, amount and issuance shall be subject to the discretion of BetClick, and shall be non-transferable. Any bonus offered by the company is limited to one per household. To withdraw the bonus, the bonus (or other promotional actions) received must have been bet three times, on one or more bets on different matchs, with a minimum 1.20 odds. To receive the BetClick bonus these bets must be a winner on an event with three or more outcomes. Concerning the credit and balance of accounts that have received promotional actions (welcome bonus, refer-a-friend, cash-back bets, free bets), it is stated that only one bonus can be granted per email address and per used credit card. The same rule will be applied for refer-a-friend: no bonus will be granted for referring friends with the same email address or the same credit card as the referrer. For accounts credited with bonus amounts - your first bet will be taken from your initial deposit and then from your bonus. If you try to withdraw the bonus amount immediately after making your first deposit the bonus amount will not be credited and automatically cancelled.

13. Winnings, refund and cancellation policy

When a single bet is won, the net winnings correspond to the amount of the stake multiplied by the odds, less the stake itself. When a multiple combination bet (accumulator) is won, the winnings correspond to the initial stake multiplied by the multiplication of the odds for each of the events that you predicted. Before undertaking the first payment of winnings generated by a member, BetClick shall request the customer to send a copy of his identity card (or any other document proving his identity). This document will enable the company to check that the personal data given during the member's registration corresponds to what appears on the document. In the event that this data is different, BetClick shall reserve the right to cancel the bets along with the payment of winnings to the member in question, unless the client can demonstrate his entitlement to the balance by some other means. BetClick reserves the right to correct any potential calculation errors in a customer's account balance at any time, including for bets whose winnings have been awarded. The company undertakes to communicate to the member concerned the statement of the corrections made. The maximum amount of winnings payable to the customer is limited to 10,000 Euros per customer and per bet if it concerns a single or a multiple. BetClick will apply this rule without having to notify the customer - at the time that he confirms his bet - that the potential payout for the bet he has just placed is higher than the maximum amount of 10,000 Euros, which will be paid to him if he wins his bet. The limit of winnings that can be accumulated by any one customer during one week (from Monday at 00.00 to the following Sunday at 24.00 (Central European Time) is 25,000 Euros. The minimum stake for any bet is 1 Euro. There is no stated maximum limit for bets, however BetClick reserves the right to limit the maximum stake for certain bets, without communicating them on the website. If this is the case and you place a bet whose stake exceeds the limit fixed by the company, the system will nonetheless accept your bet at a lower stake and inform you about it. If a customer has placed several identical bets (single bets or bets in one or several multiple combinations) whose winnings exceed the fore mentioned limits, BetClick shall reserve the right to reduce the stakes placed by the customer on the bets concerned such that the customer's winnings remain within the defined winnings' limits. Any complaint with regard to the account statements or account balance should be communicated to BetClick within 14 days from the publication of the information on the site which has given rise to the complaint. Continued use of the site by a member during a period of more than 14 days from the publication date of his account statements, without any complaint being made with regard to them, shall be deemed as acceptance of this information by the member.

14. Bets

Any bets placed through the BetClick site are binding on both parties: the company on the one side, and the member who placed the bet on the other. Each bet is considered to be effective once the member confirms his bet on the BetClick site and as soon as the confirmed stake appears in the member's account. Once the bet has been confirmed, the member can no longer cancel it, nor alter its features. BetClick reserves the right to refuse to accept any bet without notification, justification or compensation. BetClick shall in no way be held liable for typing, transmission or odds errors. BetClick reserves the right to subsequently correct, with retroactive effect, obvious errors concerning the entry of odds and/or results (for example: a mistaken inversion of teams, odds, results, etc.). You declare that you have not been informed of the result of the event(s) involved in your bet(s) at the time the bet was placed. You cannot place a bet involving an event in which you are taking active part, in any capacity. In this case, BetClick shall reserve the right to void the bet(s) concerned. In the event that information likely to make the result of a competition predictable is made public during the bet acceptance period, BetClick shall be allowed to void the bet concerned. For individual bets, this means the company will refund the stake into the user's account. In a combination bet, this means that the combined bet stands but the total odds will be calculated without the odds of the bet that has been declared void, that is this bet will be evaluated at odds of 1.00. The time indicated by BetClick constitutes the limit (deadline) after which you will no longer be allowed to place a bet, irrespectively of the real starting time of the event. BetClick applies the rule according to which the participant at a competition is declared to be a winner at the latest on the same day as the competition at midnight. Any modification of the results or classification arising after this time limit, such as a disciplinary measure, will therefore have no incidence on the result of the competition, which has been stated earlier. However, in the event that proof is established that a competition has been fixed, BetClick reserves the right to void bets involving this competition such that the customer recovers his stake. When an event (match or competition) is cancelled or postponed or abandoned, any relevant bets still remain valid if the event is resumed within 48 hours from its original starting time, otherwise bets will be deemed void. However, bets related to results already acquired at the moment of suspension (for example, the half-time result) will be settled regularly. In the event that the competitions are presented erroneously (e.g. inversion of the visiting/home teams, an opponent not playing against the displayed team), the bets concerned will be deemed void. In the event of at least two competitors being declared the winner (Dead Heat), the odds will be resettled so your winnings would be divided by the number of "Dead Heat" winners. Example: In a Formula 1 race. Schumacher has odds of 6.00 for victory and Alonso at odds of 3.00 Both cars pass the finish line at the exact same time and both drivers are declared the winner. If you have bet 5 euros on Schumacher's victory, your winnings will be then calculated like this: 5 x (((6-1)/2) + 1) = 17.5 euros of winnings If you have bet 10 euros on Alonso's victory, your winnings will be calculated like this: 10 x (((3-1)/2) + 1) = 20 euros of winnings In case discrepancy/discordance between name and number of a competitor, BetClick will take the name of the competitor in consideration for the outcome of the bets.
